Every item offered by Stitt Gallery is a unique antique or collectible piece, individually described with its condition, dimensions and, where known, provenance. Photographs form part of the description and reflect the item's actual current condition.
Prices are shown in euro (EUR) or Polish złoty (PLN) as indicated on each listing and are final consumer prices. Prices do not include shipping, transit insurance, or any import duties, taxes or customs fees applicable outside the European Union — these are quoted separately, per destination, before a sale is confirmed.
Sales may be accounted for under the EU "VAT margin scheme" for second-hand goods (Article 120 of the Polish VAT Act, implementing Article 315 of EU Directive 2006/112/EC). Under this scheme, VAT is calculated on the dealer's margin rather than the full sale price, and the sales document will not show VAT itemized separately.
Because each item is one of a kind, Stitt Gallery does not operate an automated checkout. Enquiries are made via the contact form, email or WhatsApp shown on each item's page. A sale is concluded once Stitt Gallery confirms — in writing — availability, final price and delivery terms, and the buyer confirms intent to purchase and makes payment (in full, or a deposit agreed individually). Neither party is bound before that confirmation.
Payment is made by bank transfer to the account provided by Stitt Gallery, or by another method agreed individually, in the currency shown on the item (EUR or PLN).
In-person collection — free of charge. The preferred way to receive an item is collection in person from the Stitt Gallery premises in Poznań, by prior appointment. Collection is free.
Stitt Gallery ships within Poland, across the EU, and internationally, using specialist fine-art and antiques carriers with packaging and insurance appropriate to the item. Estimated delivery time and shipping cost (including transit insurance) are quoted individually before a sale is confirmed, based on destination, size and value. For deliveries outside the EU, the buyer may be responsible for import duties, taxes or customs fees under the destination country's rules — these are not included in the item price or shipping quote.
Genuine antiques — import duty. Under the Harmonized System used by customs authorities worldwide, items classed as genuine antiques — more than 100 years old at the date of import — fall under tariff heading 9706 and are admitted free of customs duty in most major markets, including the United States, United Kingdom, Canada and Australia. Where a listing states an age or period placing the piece over 100 years old, it qualifies for this treatment; please check the dated description on the individual item, as not every piece in our collection is more than 100 years old (some are 20th-century pieces sold on their design merit rather than as antiques in the customs sense). This duty exemption applies to customs duty only — import VAT or sales tax, where applicable in the destination country, is a separate charge and is not waived by antique status.
For consumer sales, risk of accidental loss or damage passes to the consumer only on delivery, not on handover to the carrier, in line with EU consumer protection rules.
Purchases made remotely. If you are a consumer and purchased an item remotely — without having viewed it in person at the gallery beforehand — you have the right to withdraw from the purchase within 14 days of receiving the item, without giving a reason, under the EU Consumer Rights Directive (2011/83/EU) as implemented in Polish law.
To exercise this right, send a clear statement (e.g. by email to joanna@stittgallery.com) before the 14-day period ends. You must then return the item within 14 days of that statement, in its original or equivalent protective packaging. You bear the direct cost of return shipping, unless we have agreed otherwise or failed to inform you of this cost.
We will refund all payments received, including standard delivery cost, within 14 days of receiving your withdrawal notice — though we may withhold the refund until the item is received back, or proof of return shipment is provided, whichever is earlier. You are liable for any diminished value resulting from handling beyond what is necessary to establish the item's nature and characteristics — a meaningful consideration with fragile, one-of-a-kind antiques.
Purchases made in person. Under Article 3(1) of the Polish Consumer Rights Act, the distance-selling rules above — including the 14-day withdrawal right — do not apply to sales concluded during an in-person visit to the gallery in Poznań, where you had the opportunity to inspect the item directly before buying. Such purchases are final sale, subject to the statutory warranty rights described in Section 7.
Business buyers. The withdrawal right in this section applies to consumers only. It does not apply to buyers purchasing in a professional capacity (for example, other dealers buying for resale) — return terms for such purchases are agreed individually.
Video inspection. We're happy to arrange a live video call to inspect an item closely before you buy, and we encourage it for remote purchases. Please note this does not change your rights: under EU law a sale remains a distance sale — with the full 14-day withdrawal right described above — whenever it is agreed and paid for remotely, regardless of how the item was viewed beforehand. The right of withdrawal cannot be waived by agreement. It applies as an in-person sale only where the sale is actually concluded during your physical visit to the gallery in Poznań.
Stitt Gallery is liable to consumers for any lack of conformity present at the time of delivery and discovered within 2 years of that date, under the Polish Consumer Rights Act and Civil Code (rękojmia).
Because these are antique or used items, their condition — including wear, patina, minor losses, prior repairs or other age-appropriate characteristics — is disclosed and photographed on each item's page. Disclosed characteristics form part of the agreed description and are not grounds for a complaint. A complaint may only concern a defect or non-conformity that was not disclosed in the listing.

Stitt Gallery is the controller of personal data submitted through this site, processed to fulfil orders, respond to enquiries and, where consented, for marketing, under the EU General Data Protection Regulation (GDPR). A dedicated Privacy Policy is planned as a separate document.
This English page is a translation provided for convenience; the Polish Regulamin is the governing legal text. Polish law applies to sales made through this site; for consumers habitually resident in another EU member state, this choice of law does not deprive you of protections that cannot be waived by contract under the law of your own country of residence.
